In this case the a famous Club in the State of Kuwait had placed a project under the BOT system despite the fact that the project did not fall under the BOT permitted projects. Therefore the BOT contract related to this proposed project was invalid and resulted in losses and expenses incurred by Al Markaz’s client which Al Markaz sought to recover as compensation in conjunction with a successful cancellation of the BOT contract.
